Acceptable Use Policy

1. Introduction
This Acceptable Use Policy ("AUP") governs your use of the evalu8 platform. This policy is part of our Terms of Service and applies to all users.
By using evalu8, you agree to comply with this AUP. Violations may result in suspension or termination of your access, with or without notice.
2. Professional Conduct Standards
evalu8 is a professional business platform. You agree to:
- Act professionally: Treat all users with respect and professionalism
- Be honest: Provide accurate information in tenders, quotes, and company details
- Communicate appropriately: Use professional language in all platform communications
- Honor commitments: Submit quotes and respond to tenders in good faith
- Respect confidentiality: Do not share sensitive tender information without authorization
3. Prohibited Activities
3.1 Illegal Activities
You must not use the Platform to:
- Violate any Australian federal, state, or local laws
- Engage in fraud, misrepresentation, or deceptive conduct
- Infringe intellectual property rights of others
- Engage in anti-competitive conduct or price fixing
- Violate construction industry regulations or licensing requirements
- Money laundering or financing illegal activities
3.2 Security & System Integrity
You must not:
- Attempt to gain unauthorized access to the Platform or other user accounts
- Circumvent or disable security features
- Introduce viruses, malware, or harmful code
- Perform security penetration testing without written permission
- Use automated tools, bots, or scrapers to access the Platform
- Overload or attempt to disrupt platform infrastructure (DDoS attacks)
- Reverse engineer, decompile, or attempt to extract source code
- Probe for vulnerabilities or exploit security weaknesses
3.3 Abuse & Harassment
You must not:
- Harass, threaten, or intimidate other users
- Send spam, unsolicited communications, or chain messages
- Post or share defamatory, offensive, or discriminatory content
- Stalk or track other users
- Impersonate another person, business, or entity
- Create false or misleading company profiles
3.4 Fraudulent Conduct
You must not:
- Submit false or fraudulent quotes or tenders
- Misrepresent your qualifications, licenses, or capabilities
- Use another person's ABN or business credentials
- Manipulate tender processes or collude with other users
- Submit bids with no intention to honor them
- Provide false company information or references
3.5 Content Violations
You must not upload or share:
- Copyrighted material you don't have rights to use
- Confidential information belonging to third parties
- Pornographic, violent, or otherwise inappropriate content
- Content that violates privacy rights
- Misleading or false tender documents
- Malicious files or embedded code
3.6 Account Misuse
You must not:
- Share your account credentials with others
- Create multiple accounts to circumvent restrictions
- Use the Platform if your access has been suspended or terminated
- Allow unauthorized persons to access your account
- Create accounts using false information
- Sell, transfer, or sublicense your account
3.7 Commercial Misuse
You must not:
- Use the Platform for purposes other than construction tendering
- Advertise or promote third-party products or services
- Extract data to build competing services
- Resell or redistribute Platform access
- Use the Platform for recruiting or headhunting without permission
4. Confidentiality & Data Protection
4.1 Tender Confidentiality: Tender information shared on the Platform is confidential. You must not disclose tender details, pricing, or scope information to third parties without authorization from the head contractor.
4.2 Competitor Information: You must not use the Platform to gather competitive intelligence or share tender information with competitors.
4.3 Data Protection: You must comply with Australian privacy laws when handling personal information accessed through the Platform.
5. Beta Testing Responsibilities
As a closed beta user, you agree to:
- Report issues: Promptly report bugs, errors, or security vulnerabilities to noah@nunu.pro
- Provide feedback: Share constructive feedback to help improve the Platform
- Test responsibly: Do not use the Platform for critical production workflows
- Maintain confidentiality: Do not publicly disclose beta features or platform issues without permission
- Accept limitations: Understand that beta software has limitations and risks
6. Construction Industry Compliance
When using the Platform, you remain responsible for:
- Maintaining valid business licenses and certifications
- Complying with NSW building and construction regulations
- Meeting insurance requirements
- Adhering to workplace health and safety laws
- Following fair trading and consumer protection laws
- Meeting tax obligations (including GST if applicable)
The Platform does not verify compliance with industry regulations. You are solely responsible for ensuring your use of the Platform complies with all applicable laws and industry standards.
7. Monitoring & Enforcement
7.1 Right to Monitor: We reserve the right to monitor Platform usage to ensure compliance with this AUP, though we are not obligated to do so.
7.2 Investigation: We may investigate suspected violations and cooperate with law enforcement authorities.
7.3 Enforcement Actions: Violations may result in:
- Warning notices
- Temporary account suspension
- Permanent account termination
- Removal of content
- Reporting to relevant authorities
- Legal action for damages
7.4 No Liability for User Conduct: We are not responsible for user conduct or content. Users violating this AUP are solely liable for their actions.

If you become aware of conduct that violates this AUP, please report it to:

9. Changes to This Policy
We may update this Acceptable Use Policy from time to time. Material changes will be notified via email or platform notification. Continued use of the Platform after changes constitutes acceptance of the updated policy.
